What Is Real Estate Tax in Egypt? A Complete Guide for Owners

Does owning an apartment or house in Egypt necessarily mean paying real estate tax? And is this tax different from the tax imposed when selling a property?

The answer depends on the nature and status of the property and the rules that apply to it, particularly following the new amendments and facilitations introduced in 2026.

What Is the Real Estate Tax in Egypt?

Real estate tax is a recurring tax imposed on built properties under the Real Estate Tax Law. 

It is not a new tax; it was previously known as “Al-Awaed” under Law No. 56 of 1954. Its provisions were subsequently reorganized under Law No. 196 of 2008, with later amendments addressing certain provisions, including Law No. 117 of 2014.

The tax is calculated based on the estimated net annual rental value of the property. This value is determined by the assessment committees based on criteria including the property's location, building standard, and connected utilities.

The rental value used for tax purposes does not necessarily represent the actual rent collected by the owner from the tenant. Rather, it is an estimated value used to determine the taxable base.

What Properties Are Subject to Real Estate Tax in Egypt?

The tax applies to built properties located on Egyptian land, including houses, apartments, and residential and non-residential units, subject to the rules and exemptions established by law. 

The taxpayer is the person who has the right to own, use, or exploit the property, while the tenant is not considered the primary taxpayer, although the tenant may be jointly liable for payment within the limits of the rent due.

A property or unit is treated according to its nature and use when applying the tax rules. 

Therefore, a person does not have to own the entire building for tax obligations to arise in relation to a unit they own or have the right to use.

As for the main private residence, the law provides a specific exemption threshold, which was changed under the 2026 amendments, as explained in the section on exemptions.

How Is Real Estate Tax Calculated?

The tax rate is 10% of the net annual rental value. To determine the net annual rental value, a deduction for maintenance expenses is applied at 30% for residential units and 32% for non-residential units, after which the tax rate is applied to the remaining amount.

Real Estate Tax Calculation Example

If the estimated annual rental value of a residential unit is EGP 100,000:

  • Value after the 30% maintenance deduction: EGP 70,000.

  • Basic tax at 10%: EGP 7,000 annually.

This example illustrates the basic calculation for a unit that is not subject to an exemption. If the unit is the taxpayer's main private residence, the applicable exemption threshold is applied before calculating the tax on the taxable portion.

What Is the New Real Estate Tax Schedule?

Real estate tax does not follow a progressive tax-bracket system in which the tax rate increases as the property's value increases. 

The basic tax rate is fixed at 10% of the net annual rental value after the deductions prescribed by law.

The difference in the amount of tax from one property to another depends on the estimated rental value, the property's use, and any applicable exemptions and special rules.

One of the key 2026 amendments is that the estimated rental value remains effective for five years, while the Real Estate Tax Authority is required to publish details of the indicative pricing map at least 90 days before the new assessment takes effect.

What Are the Conditions for Real Estate Tax Exemption?

The law provides for several exemption cases depending on property ownership and use. 

These include certain properties owned by entities with specific legal characteristics, headquarters of political parties and syndicates, youth and sports centers, and other cases established by law subject to their respective conditions.

This does not mean that every property belonging to one of these entities is automatically exempt. 

The exemption depends on meeting the legal requirements applicable to each case.

For the main private residence, the 2026 amendment raised the exemption threshold to EGP 100,000 of net annual rental value, equivalent to a market value of up to EGP 8 million per unit, according to estimates announced by the Real Estate Tax Authority. 

The private residence refers to the unit used as the main residence by the taxpayer, their spouse, and minor children, subject to the applicable legal conditions.

The exemption request for the main residence is submitted with the electronic tax declaration. The required documents vary depending on the exemption case relied upon.

How Do You Register for Real Estate Tax and File the Tax Declaration?

The taxpayer files a declaration for a property in which they hold ownership, usufruct, or exploitation rights. 

In the case of the five-year general survey, the declaration is submitted during the second half of the year preceding the survey, while specific deadlines apply to newly constructed properties, newly added units, or modifications that affect the rental value.

Tax declarations can now be submitted either in paper form or electronically. 

The Real Estate Tax Authority has also launched the Egyptian Real Estate Tax application for filing declarations, requesting the main-residence exemption, making payments on account, and settling outstanding tax liabilities electronically.

If a taxpayer owns more than one property within the jurisdiction of different tax offices, the latest amendment allows them to submit one declaration to any of those offices instead of filing a separate declaration with each office.

What Is the Deadline for Filing the Real Estate Tax Declaration and What Happens If You Are Late?

The Real Estate Tax Authority extended the deadline for filing declarations until September 30, 2026, while providing incentives for compliant taxpayers.

Starting next year, taxpayers will receive a 25% discount for residential units and 10% for non-residential units on the tax due, with an additional 5% discount for payment on account, bringing the total discount to 30% for residential units and 15% for non-residential units, subject to the applicable rules.

As the deadline approached, some users experienced difficulties accessing the application due to increased demand. 

Mohamed El-Sayed, Deputy Head of the Real Estate Tax Authority, said that the authority was working with the technology provider to resolve the issues and improve the service. 

The authority also provided alternative service points at clubs and new cities' administrative bodies to help citizens submit their declarations and access the required services.

In a related statement, Ramy Youssef, Assistant Minister of Finance and Head of the Real Estate Tax Authority, explained during a telephone interview with Amr Adib on the Al-Hekaya program that taxpayers who had never previously received a tax assessment notice or a prior tax demand, and who voluntarily submitted their declarations, would not be required to pay previous liabilities dating back to 2013. 

Those who had previously received a tax assessment are treated differently according to their existing legal status.

Failure to submit the declaration or submitting incorrect information is subject to the penalties prescribed by law. 

This is separate from the late-payment charge resulting from failure to pay the tax due on time.

The current facilitations also provide for waiving late-payment charges in cases covered by the applicable decision when the principal tax due for previous periods is paid.

How Can You Pay Real Estate Tax Online?

Real estate tax can be paid electronically through the digital services provided by the Real Estate Tax Authority for properties included in the electronic system. 

These services include settling outstanding liabilities and making payments on account.

The latest facilitations also allow the tax and late-payment charges to be paid in installments through electronic payment methods in accordance with the applicable rules.

The authority recognizes electronic payment receipts, so taxpayers should retain the receipt after completing the payment as proof that the amounts due have been paid.

Real Estate Transaction Tax in Egypt

Real estate transaction tax differs from annual real estate tax. It is not triggered simply by owning a property; rather, it is a one-time tax governed by the Income Tax Law and imposed at a rate of 2.5% of the total value of the transaction, such as a sale, with no maximum cap. 

It applies to taxable transactions involving built properties and land intended for construction in accordance with the applicable rules.

Who Pays Real Estate Transaction Tax When Selling a Property?

The legal obligation to pay the tax falls on the seller, not the buyer.

The amendments also unified the tax rate for individuals who do not engage in real estate investment activity, regardless of the number of transactions they carry out. 

They also introduced a full exemption for sales between spouses, children, and direct descendants, and extended the notification and payment period to 60 days instead of one month.

How Can You Check Real Estate Transaction Tax and Apply for an Exemption?

The Egyptian Tax Authority launched a separate real estate transaction application, independent from the annual real estate tax application. 

The new digital system allows users to register the sale, upload documents, calculate and pay the tax, and ultimately print the approved tax clearance certificate. 

Its initial phase is limited to taxpayers in Greater Cairo and Alexandria, with plans for gradual expansion.

Exemptions apply to cases specified by law and subject to the relevant conditions, including certain transactions between first-degree relatives, such as spouses and direct descendants.

Real Estate Transaction Tax and Signature Validation

Obtaining a signature validation judgment does not mean that the real estate transaction tax has been paid, nor does it replace the official tax clearance. 

A signature validation lawsuit is limited to establishing the authenticity of the signatures of the parties to the contract, while the real estate transaction tax remains a separate financial obligation that must be paid through the relevant digital system or tax office to complete the required procedures.
